Madras HC wants contact details clearly mentioned in case documents – The New Indian Express

MADURAI: The Madurai Bench of the Madras High Court has requested the Registrar of all Courts in Tamil Nadu and Pondicherry to ensure that the contact details such as name, residential address, mobile phone number, e-mail id, etc., are clearly mentioned in the documents of the case at the time of filing records.

Judge SM Subramaniam gave the instruction while hearing a motion filed on December 15 last year. The petitioner’s lawyer told the court that the petitioner had attempted to serve a notice of appeal on the opposing party for the past three months, but was unable to find his address.

In hearing the plea, the judge observed that a large number of civil cases (miscellaneous motions and second appeals) have been pending for years for lack of notification to the opposing parties. “This is because the complaint and the appeal lawsuit do not contain the correct addresses of the parties, as the original lawsuits are filed in the trial court,” he added. He felt that if such delays continued, litigants would lose confidence in the judiciary.

Emphasizing that Order 7 Rule 1 of the Code of Civil Procedure (CPC) states that a complaint must contain full particulars, including the name of the court, the name and description of the residence of the plaintiff and the defendant, among others , the judge said this rule should be followed strictly by mentioning the contact details legibly.

He also added that a self-attested copy of the Aadhaar card could be attached when filing the case documents. “Insufficient or unclear address should not be admitted in the complaint and all such complaints should be referred by the court registry itself,” he said.

The judge instructed the High Court Registry to forward the order to all courts in Tamil Nadu and Pondicherry to ensure strict compliance.
